a microsoft começou a abrir o que pode vir a ser uma caixa de pandora na disputa com o mundo open source. segundo seu chief counsel Brad Smith o kernel de linux infringe 42 patentes da companhia e outros sistemas abertos, como open office, outras 193 patentes.  segundo Horacio Gutierrez,  VP for intellectual property and licensing, "It’s important for everyone to understand that there is a real problem with Linux patents and that there is a need for a solution". ninguém falou em processar ninguém, mas sabe-se que a msft já recolhe direitos de usuários de software livre, principalmente grandes empresas que entendem ser muito alto o risco de litígio futuro. próximos passos? ninguém comentou. parte de uma campanha de FUD [fear, uncertainty & doubt]? talvez sim, talvez não. começo de uma discussão para limpar a área? quem sabe?… tomara.

    A dificuldade é:

    “It’s one of the few operating systems that represents a viable threat that Microsoft has a great deal of difficulty containing,” Gillen said, because the developers share their code. “Microsoft can’t drive a company out of business and make Linux go away,” the analyst said.

    If Microsoft were to start suing, it could also kick off a patent war on a grand scale. An organization called the Open Innovation Network, funded by IBM Corp., Red Hat Inc. and others, has amassed a vast number of software patents. In the event of a Microsoft lawsuit against open source companies or customers, the OIN would retaliate in kind.

    “We believe it’s highly likely that Microsoft would infringe some of our patents,” said Jerry Rosenthal, OIN’s chief executive.
